Introduction
Your privacy is very important to me and you can be confident that your personal information will be kept safe and secure and will only be used for the purpose it was given to me.
I adhere to current data protection legislation, including the General Data Protection Regulation (EU/2016/679) (the GDPR), the Data Protection Act 2018 and the Privacy and Electronic Communications (EC Directive) Regulations 2003. This privacy notice tells you what I will do with your personal information from initial point of contact through to after your therapy has ended, including:

‘Data controller’ is the term used to describe the person/ organisation that collects and stores and has responsibility for people’s personal data. In this instance, the data controller is me. I am registered with the Information Commissioner’s Office 00019029494.

My lawful basis for using and controlling your information
The GDPR states that I must have a lawful basis for processing your personal data. There are different lawful bases depending on the stage at which I am processing your data. I have explained these below:

If you have had therapy with me and it has now ended, I will use legitimate interest as my lawful basis for holding and using your personal information.
If you are currently having therapy or if you are in contact with me to consider therapy, I will process your personal data where it is necessary for the performance of our contract.
The GDPR also makes sure that I look after any sensitive personal information that you may disclose to me appropriately. This type of information is called ‘special category personal information’. The lawful basis for me processing any special categories of personal information is that it is for provision of health treatment (in this case counselling) and necessary for a contract with a health professional (in this case, a contract between me and you).
How I use your information
Initial contact.
When you contact me with an enquiry about my counselling services I will collect information to help me satisfy your enquiry. This will include your name, email address, phone number and what concerns you would like support with.
Alternatively, your GP or other health professional may send me your details when making a referral or a parent or trusted individual may give me your details when making an enquiry on your behalf.

If you decide not to proceed, I will ensure all your personal data is deleted within 6 months. If you would like me to delete this information sooner, just let me know.
While you are accessing counselling.
Rest assured that everything you discuss with me is confidential. That confidentiality will only be broken if 1) I think that you have become a danger to yourself or other people, 2) if in good faith I feel that I can assist in the prevention or detection of a serious crime, this includes safeguarding issues regarding children or vulnerable adults, crimes regarding substantial financial gains and losses, and acts of terrorism, and 3) Finally, if I am subpoenaed by court to share any information then I must do so upon request. Additionally, I regularly present my work in clinical supervision, the aim of this is to monitor and improve my practice. All supervision is done on a confidential basis, using the client’s code or pseudonym. If I would have to breach your confidentiality, I would inform you and include only information that was pertinent. I will always try to speak to you about this first, unless there are safeguarding issues that prevent this.
I will keep a record of your personal details to help the counselling services run smoothly. These details are kept securely and are not shared with any third party. Notes are kept through a personal account on the encrypted GDPR compliant website www.konfidens.com . You are able to access their privacy policy and data processing agreement on their website.
I will keep written notes of each session, these are kept up to 3 years and deleted afterwards.
For security reasons I do not retain text messages for more than one week. If there is relevant information contained in a text message I will upload a screenshot to your electronic record on my account on www.konfidens.com and delete the photo immediately after upload. Likewise, any email correspondence will be deleted after 1 month if it is not important. If necessary I will upload a copy of the email to your electronic client record on my account on www.konfidens.com .
After counselling has ended.
Once counselling has ended your records will be kept for 3 years from the end of our contact with each other and are then securely destroyed. If you want me to delete your information sooner than this, please tell me.
Third party recipients of personal data
I sometimes share personal data with third parties, for example, where I have contracted with a supplier to carry out specific tasks. In such cases I have carefully selected which partners I work with. I take great care to ensure that I have a contract with the third party that states what they are allowed to do with the data I share with them. I ensure that they do not use your information in any way other than the task for which they have been contracted.

Your rights
I try to be as open as I can be in terms of giving people access to their personal information. You have a right to ask me to delete your personal information, to limit how I use your personal information, or to stop processing your personal information. You also have a right to ask for a copy of any information that I hold about you and to object to the use of your personal data in some circumstances.

Data Security
I take the security of the data I hold about you very seriously and as such I take every effort to make sure it is kept secure. For any recording of your data, it is all recorded the GDPR compliant, encrypted website www.konfidens.com and all other data is deleted within the timeframes stipulated above.
Visitors to my website
When someone visits my website, I use a third party service, www.wix.com to collect standard internet log information and details of visitor behaviour patterns as well as for content management of the site. I do this to find out things such as the number of visitors to the various parts of the site. This information is only processed in a way that does not identify anyone. I do not make, and do not allow www.wix.com to make, any attempt to find out the identities of those visiting my website.

Retention
I will retain your personal information for as long as necessary to provide my services, and as necessary to comply with my legal obligations, resolve disputes and enforce my policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable opportunity. Under applicable regulations, I will keep records containing client personal data, account opening documents, communications and anything else as required by applicable laws and regulations.
I may rectify, replenish or remove incomplete or inaccurate information, at any time and at my own discretion.
Grounds for data collection
Processing of your personal information (i.e. any information which may potentially allow your identification through reasonable means; hereinafter "Personal Information") is necessary for the performance of my contractual obligations towards you and providing you with my services, to protect my legitimate interests and for compliance with legal and financial regulatory obligations to which I am subject.
When you use the Site, you consent to the collection, storage, use, disclosure and other uses of your Personal Information as described in this Privacy Policy.
I encourage my Users to carefully read the Privacy Policy and use it to make informed decisions.
What information do I collect?
I collect two types of data and information from Users.
The first type of information is unidentified and non-identifiable information pertaining to a User(s), which may be made available or gathered via your use of the Site (“Non-personal Information”). I am not aware of the identity of a User from which the Non-personal Information was collected. Non-personal Information which is being collected may include your aggregated usage information and technical information transmitted by your device, including certain software and hardware information (e.g. the type of browser and operating system your device uses, language preference, access time, etc.) in order to enhance the functionality of my Site. I may also collect information on your activity on the Site (e.g. pages viewed, online browsing, clicks, actions, etc.).
The second type of information Personal Information , which is individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual. Such information includes:

How do I receive information about you?

My policy only addresses the use and disclosure of information I collect from you. Accordingly, I encourage you to read the terms and conditions and privacy policy of each third party that you choose to disclose information to.
This Privacy Policy does not apply to the practices of companies that we do not own or control, nor to individuals whom I do not employ or manage, including any of the third parties which I may disclose information to as set out in this Privacy Policy.
How do I safeguard your information?
I take great care in implementing and maintaining the security of the Site and your information. I employ industry standard procedures and policies to ensure the safety of the information I collect and retain, and prevent unauthorised use of any such information, and I require any third party to comply with similar security requirements, in accordance with this Privacy Policy. Although I take reasonable steps to safeguard information, I cannot be responsible for the acts of those who gain unauthorised access or abuse my Site, and I make no warranty, express, implied or otherwise, that I will prevent such access.
Transfer of data outside the EEA
Please note that some data recipients may be located outside the EEA. In such cases I will transfer your data only to such countries as approved by the European Commission as providing adequate level of data protection, or enter into legal agreements ensuring an adequate level of data protection.
Advertisements
I may use a third-party advertising technology to serve advertisements when you access the Site. This technology uses your information with regards to your use of the Services to serve advertisements to you (e.g., by placing third-party cookies on your web browser).

I may use your Personal Information such as your name, email address, telephone number, etc., myself or by using my third-party subcontractors, for the purpose of providing you with promotional materials concerning my services which I believe may interest you.
To respect your right to privacy, within such marketing materials I provide you with the means to opt out of receiving further marketing offers from me. If you unsubscribe, I will remove your email address or telephone number from my marketing distribution lists.
Please note that even if you have unsubscribed from receiving marketing emails from me, I may send you other types of important email communications without offering you the opportunity to opt out of receiving them. These may include customer service announcements or administrative notices.
Corporate transaction
I may share information in the event of a corporate transaction (e.g. sale of a substantial part of my business, merger, consolidation or asset sale). In the event of the above, the transferee or acquiring company will assume the rights and obligations as described in this Privacy Policy.
Minors
I understand the importance of protecting children’s privacy, especially in an online environment. The Site is not designed for or directed at children. Under no circumstances shall I allow the use of my services by minors without prior consent or authorisation by a parent or legal guardian. I do not knowingly collect Personal Information from minors. Updates or amendments to this Privacy Policy
I reserve the right to periodically amend or revise the Privacy Policy; material changes will be effective immediately upon the display of the revised Privacy policy. The last revision will be reflected in the "Last modified" section. Your continued use of the Platform, following the notification of such amendments on my website, constitutes your acknowledgment and consent of such amendments to the Privacy Policy and your agreement to be bound by the terms of such amendments.
